Terms of service
**Sparrow Expeditions**
**Effective date: June 7, 2026**
Please read these Terms of Service ("Terms") carefully. They are a binding agreement between you ("you," "your," "Customer") and Sparrow Expeditions ("Sparrow Expeditions," "we," "us," "our"). By accessing or using our website, The Forge software and tools, our subscriptions, our products, or our services, you agree to these Terms. If you do not agree, do not use them.

## 1. What We Provide
Sparrow Expeditions provides, among other things:
- **The Forge** — web-based software and tools for arrow building, bow tuning, spine and FOC calculation, ballistic/wind-drift estimation, sight-tape generation, and related features, offered free and through paid subscriptions ("Subscriptions").
- **Products** — physical goods such as arrows, components, nocks, inserts, and related archery equipment ("Products").
- **Atelier Services** — one-on-one tuning, coaching, custom builds, and bench work ("Services").
We may add, change, suspend, or discontinue any part of the foregoing at any time.
## 2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase or hold an account. You are responsible for your account credentials and for all activity under your account. Keep your password secure and notify us promptly of any unauthorized use. You agree to provide accurate, current information and to keep it updated.
## 3. Subscriptions, Billing & Auto-Renewal
- Paid Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and **renew automatically** until cancelled.
- By subscribing, you authorize us and our payment processors to charge your payment method on each renewal at the then-current price.
- You may cancel at any time; cancellation stops future renewals. Cancellation takes effect at the end of the current paid billing period, and you retain access until then.
- We may change Subscription prices or features. We will give reasonable notice of price increases, which take effect on your next renewal. Continued use after a change constitutes acceptance.
## 4. All Sales Final — No Refunds
**To the maximum extent permitted by applicable law, all purchases are final and non-refundable.** This includes, without limitation:
- **Subscriptions and digital access** — Subscription fees are non-refundable in whole or in part, including for unused time, partial billing periods, downgrades, cancellations, account termination, or periods of non-use. When you cancel, you keep access until the end of the period you have already paid for; you are not charged again and you are not refunded for the remainder.
- **Custom and made-to-order Products and Services** — custom arrow builds, Atelier tuning, coaching, bench days, and other personalized work are non-refundable and non-cancellable once work has begun, because they are produced or performed specifically for you.
- **Stock Products** — sales of physical Products are final.
**Nothing in this Section limits any rights you have under applicable consumer-protection law that cannot be waived** (for example, statutory rights relating to goods that are defective, damaged in transit, or not as described). If a Product arrives defective or damaged, contact us within a reasonable time at sal@sparrowexpeditions.com and we will work with you in good faith to repair, replace, or otherwise make it right as required by law. We do not, however, offer refunds, returns, or exchanges for reasons of buyer's remorse, change of mind, fit/preference, or results in the field.
Chargebacks or payment disputes filed in lieu of contacting us first are a breach of these Terms and may result in suspension of your account and Services.
## 5. The Forge Tools — Estimates, Not Guarantees
The Forge's calculators, scores, charts, visualizers, and recommendations (including spine, FOC, kinetic energy, momentum, trajectory, wind drift, sight tapes, "kill-confidence" / ethical-range guidance, and component suggestions) are **estimates and educational aids based on models, published manufacturer data, and your inputs.** They are **not** measurements of your actual equipment, not a substitute for chronograph testing, real-world sighting-in, paper/bare-shaft tuning, or your own judgment, and they do **not** guarantee any particular accuracy, penetration, lethality, safety, or outcome.
**You are solely responsible** for verifying your equipment, confirming your tune at the range, selecting ethical shots, complying with all hunting and archery laws and regulations, and using sound judgment in the field. Garbage in, garbage out: results depend on the accuracy of the data you enter.
## 6. Assumption of Risk — Archery & Hunting
Archery, bowhunting, and the handling of bows, arrows, broadheads, and related equipment are **inherently dangerous activities that can cause serious injury or death** to you and others, and can damage property. By using our tools, Products, and Services, you acknowledge and voluntarily **assume all such risks.** You are responsible for safe handling, lawful use, proper protective measures, and the consequences of your decisions. Sparrow Expeditions does not supervise, and is not responsible for, your use of any equipment or any hunting or shooting activity.
## 7. Acceptable Use
You agree not to: (a) reverse engineer, scrape, copy, resell, or redistribute The Forge or its data except as expressly permitted; (b) use the Services unlawfully or to infringe others' rights; (c) interfere with or disrupt the Services or attempt unauthorized access; or (d) misrepresent your identity or affiliation. We may suspend or terminate access for violations.
## 8. Intellectual Property
The Forge, our website, software, data compilations, profiles, calculations, content, branding, and "Sparrow," "Sparrow Expeditions," and "The Forge" marks are owned by us or our licensors and are protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial purposes. All rights not expressly granted are reserved. Content you submit remains yours, but you grant us a license to host, display, and use it to operate and improve the Services.
## 9. Third-Party and Partner Content
The Services may reference or incorporate third-party manufacturer data, partner-branded tools, links, and integrations. We do not control and are not responsible for third-party products, content, sites, or services, and inclusion does not imply endorsement or any warranty.
## 10. Disclaimer of Warranties
**The Services, Products, tools, data, and content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind**, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, accurate, or that any result will be achieved.
## 11. Limitation of Liability
**To the fullest extent permitted by law, Sparrow Expeditions and its owners, members, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, equipment, injury, or harm, arising out of or relating to your use of (or inability to use) the Services, Products, tools, or content, even if advised of the possibility.** In no event will our total aggregate liability for all claims relating to the Services exceed the greater of (a) the amount you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.
## 12. Indemnification
You agree to defend, indemnify, and hold harmless Sparrow Expeditions and its owners, members, employees, contractors, and partners from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, Products, or Services, your violation of these Terms, your violation of any law, or your hunting, shooting, or equipment-handling activities.
## 13. Modifications
We may modify these Terms at any time by posting the updated version with a new effective date. Material changes will be communicated by reasonable means. Your continued use after changes take effect constitutes acceptance. We may also modify, suspend, or discontinue any part of the Services at any time.
## 14. Termination
We may suspend or terminate your access or account at any time, with or without cause or notice, including for breach of these Terms. Upon termination, your right to use the Services ends. Sections that by their nature should survive (including Sections 4–12) survive termination. No refund is owed on termination, consistent with Section 4.
## 15. Governing Law & Disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. You agree that the exclusive venue for any dispute not subject to arbitration or small-claims court will be the state and federal courts located in Cook County, Illinois, and you consent to their jurisdiction. You and we agree to first attempt to resolve any dispute informally by contacting sal@sparrowexpeditions.com.
## 16. General
These Terms, together with any policies referenced here (including our Privacy Policy), are the entire agreement between you and us regarding the Services and supersede prior agreements. If any provision is found unenforceable, the rest remains in effect and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them. Headings are for convenience only.
